Volunteer Release and Waiver of Liability

This Volunteer Liability Waiver and Release Agreement (“Agreement”) is entered into between the undersigned volunteer (“Volunteer”) and Trees Forever (“Organization”), regarding Volunteer’s participation in any event that is sponsored or co-sponsored by the Organization, any event that includes the use of sharp and dangerous tools such as shovels, shears, saws, gloves, etc. provided by Organization, any event that the Organization provides tools to be used, (collectively referred to as “Event”) and states as follows:

1. Assumption of Risk

Volunteer understands and acknowledges that participation in Event involves inherent risks, including but not limited to physical injury, exposure to environmental hazards, uneven terrain, falling objects, insect bites, and allergic reactions. Volunteer voluntarily assumes all risks associated with participating in this Event.

2. Release of Liability

To the fullest extent permitted by Iowa law, Volunteer, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases wives and discharges the Organization, its officers, directors, employees, agents, sponsors, partners, and affiliates (collectively, “Released Parties”) from any and all claims, liabilities, damages or causes of action arising out of or related to any injury, illness, loss, or damages sustained by Volunteer in connection with participation in the Event, including claims based on negligence of Released Parties.

3. Indemnification

Volunteer agrees to indemnify, defend and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising from Volunteer’s actions or conduct during participation in the activity.

4. Medical Treatment and Insurance

Volunteer acknowledges that the Organization does not provide medical insurance and that Volunteer is responsible for any medical costs incurred as a result of participation in Event. In the event of an injury, Volunteer authorized Organization to seek medical treatment on their behalf if necessary.

5. Compliance with Rules and Instructions

Volunteer agrees to follow all safety guidelines, rules, and instructions provided by the Organization and its representatives to minimize risk of injury or harm.

6. Photo and Media Release

Volunteer grants Organization permission to use photographs, videos, or other media taken during the Event for promotional, educational, or fundraising purposes without expectation of compensation.

7. Severability and Governing Law

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and interpreted under the laws of the State of Iowa.

8. Acknowledgment and Signature

By signing below, Volunteer acknowledges that they have read, understood, and voluntarily agreed to this Agreement, Volunteer affirms that they are at least eighteen (18) years of age or, if under eighteen (18), that a parent, legal guardian, or caretaker has signed below on their behalf.
